Terms and Conditions

Agreement between User and By the Sea Beach Weddings & Luxury Picnics (www.bytheseaflorida.com).

1. Services

1.1 By the Sea provides a luxury picnic experience in Los Angeles and surrounding areas. Our services include a 2-hour experience with a custom picnic setup with handmade low tables, a boho-style umbrella, pillows and rugs, flatware and tableware, a Bluetooth speaker, and blankets.

1.2 We’ll try to include your wishes, but our services are pre-packaged. We have the final say on aesthetic judgment and quality. For a custom event, let’s collaborate on our event planning services.

1.3 Please do not be late for your picnic. Our picnics are time and daylight sensitive, and we will not be able to extend your time if we haven’t pre-arranged a time change. We can give a 15-minute grace period.

1.4 Please do not leave your picnic setup unattended for more than a few minutes. If you are done with your picnic before the 2-hours and would like to leave just call us at 850-684-8861.

1.5 If you would like us to assist with permitting your picnic, we can provide that service with our custom event planning service at no additional charge.

1.6 We reserve the right to refuse service to anyone.

2. Weather and Location

2.1 By the Sea reserves the right to cancel or reschedule the picnic experience at any time if there is rainy weather, strong winds, high tides, or beach hazards pose a threat to the safety of our clients and staff. In such cases, we will notify the client as soon as possible and work to reschedule the picnic experience for a later date that is convenient for both parties.

2.4 If unexpected winds cause the umbrellas to become unstable, simply slide down the latch and lay them flat on the ground until the wind dies down.

2.5 If the selected location is a public space, such as a beach or park, By the Sea will do their best to find a great place that is intimate and suitable for your event. However, please note that we cannot guarantee the availability or suitability of public locations, as they are subject to various factors beyond our control. We are not allowed to ask anyone to move or to restrict anyone from being around you.

3. Payment

3.1 To secure your booking, By the Sea requires a non-refundable deposit of 50% upfront. The final payment is due 7 days prior to the event. Event setup will not occur without full payment prior. Our team takes your privacy seriously, and for security reasons, we do not store credit card details.

3.2 Payments and deposits are non-refundable to ensure we can provide the best service possible. We do not provide refunds. Once a payment or deposit is made, it is non-refundable.

4. ID Requirements

As part of our standard procedures, we may require a valid form of identification to be presented on the day of the event, to ensure that it corresponds to the details provided in the booking form. This is intended to enhance the safety and security of all attendees and to prevent any potential fraud or misrepresentation.

5. Rescheduling, cancellation & refund

5.1 Bookings secured with a deposit may be rescheduled within 3 months due to bad or severe weather or a change of mind. You can reschedule your picnic, but we require 72-hour notice in advance.  In case of Emergency cancellations please notify us as soon as possible and provide proof of emergency the full cost of the picnic will be forfeit.

To clarify, “bad weather” for rescheduling purposes does not include cloudy days or light, intermittent rain that doesn’t disrupt outdoor activities. Our definition focuses on conditions that pose safety risks or significantly impair outdoor experience, such as heavy rain, thunderstorms, severe winds, snow, and extreme heat. Cloudy skies, June grass or mild weather variations, which often provide pleasant temperatures and protection from direct sunlight, do not qualify as bad weather under our policy. We encourage our clients to embrace the beauty of nature in all its forms, with the assurance that we prioritize safety and comfort as a memorable outdoor experience.

5.2 We offer one free rescheduling. However, if you need to reschedule again or don’t provide the required notice within 72 hours, there will be a fee of $150.

5.3 By the Sea does not offer refunds due to change of mind or bad weather. In case of bad weather, we can set up your event indoors or reschedule for another date.

5.4 Please note that the deposit payment made for our services is non-refundable.

6. Equipment

6.1 Please do not sit, stand or move our equipment. Each glass, plate, fork, knife, etc., is sanitized.

6.2 You are responsible for our items during your allotted time. Please treat our equipment with care.

6.3 Please do not light our candles. They are for display only.

7. Damages Policy

The Customer shall pay for all equipment damage or loss however caused during the event. Suppose there is any damage or loss of goods such as picnic tables, umbrellas, cheese knives and utensils, boards, bowls, plates, glasses and cups, rugs, table linen, napkins, etc. In that case, the person booking will be charged accordingly and invoiced after the event. Pricing is available on request.

8. Advertising

8.1 By the Sea have the right to use all photos taken during the event for advertising purposes.

9. Alcohol

By the Sea IS NOT HELD LIABLE FOR ANY POSSESSION OF ALCOHOL OR OTHER SUBSTANCES. WHAT YOU PROVIDE IS UP TO YOUR DISCRETION, AND WE ARE NOT HELD RESPONSIBLE FOR ANY CONSEQUENCES.

11. Liability

11.1 By the Sea is not responsible for any injury, loss, or damage to people or property during the picnic. The customer assumes all risk and liability associated with the event. By the Sea shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the picnic, including but not limited to property damage, personal injury, or loss of revenue.

11.2 The customer agrees to indemnify, defend, and hold By the Sea harmless from all claims, demands, causes of action, damages, liabilities, costs, and expenses, including reasonable attorney’s fees arising from or related to the picnic.

12. Force Majeure

12.1 By the Sea shall not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations under these terms and conditions caused by events outside its reasonable control (a “Force Majeure Event”). A Force Majeure Event includes any act, event, non-happening, omission, or accident beyond our reasonable control. It includes (but is not limited to) such things as war, riot, fire, flood, earthquake, natural disasters, governmental actions, pandemic, snowstorm and other similar events.

12.2 In the event of a Force Majeure, By the Sea will try to reschedule the event but cannot guarantee availability on a specific date. If rescheduling is not possible, any fees paid will be refunded.

13. By booking your picnic, you are accountable for understanding and agreeing with these terms.

14. We reserve the right to modify, update, or change these terms and conditions at any time without prior notice. By using our services, you agree to abide by the most current version of these terms and conditions. It is your responsibility to check for updates regularly.
